Received A Single Justice Procedure Notice?

What is an SJPN?
Single Justice Procedure Notices are targeted at adults accused of less serious, non-custodial offences.  It is a relatively new procedure introduced in 2015 to enable a single magistrate (with a qualified legal advisor) to deal with cases in the absence of a defendant and not in court.

The offences are usually vehicle-related, and typically will be
for speeding or driving without a license or without insurance, or using a mobile phone while driving.  [However SPJN’s can also be served for offences like watching TV without a license or evading train fares].

Once you receive an SPJN, you will see what the prosecuting evidence is, and you will be given the choice to plead guilty or innocent and must  respond within 21 days.   It is important to appreciate that if you do not return the SJPN within this time-frame, you may well be found guilty and sentenced.

You can choose not to attend court at all or you can request an open court hearing and this will be (at least initially) in a Magistrate’s Court).

Single Magistrate Decision in your Absence
If you choose not to attend court, a single magistrate will make the ruling in your absence and you will then be notified of the decision.

The magistrate will consider the prosecution’s evidence along with any written mitigating evidence you have provided.  The magistrate will then either dismiss the charge altogether or adjudicate that you are guilty and you will be notified of the decision and the penalty if found guilty.

Even if you choose to go down this route of not attending court, it is important to consult us as we can expertly craft your mitigating circumstances to give you the best possible chance of a good outcome.

Remember, you can plead guilty and still get a “conditional discharge” and our Single Justice Procedure Notice solicitors know how to optimise this possibility for you.

If you wish to plead guilty, but the offence is deemed serious enough for a potential driving ban (for example because of prior points on your license), you will be required to attend court in any event.

Magistrate Court Hearing
If you wish to contest the Single Justice Penalty Notice, there will be a Magistrate’s Court hearing with you in attendance.  In this case, you will  undoubtedly be better off using our specialist SJPN lawyer service.

We will not only legally craft & strengthen, and then skilfully present your mitigating circumstances to the Court, but will be able to leverage any finer points of law of which you may not be aware to your benefit.

Possible Sentences
SJPN recipients for driving offences face not only fines and penalty points, but potentially face having their license suspended or even revoked and disqualified from driving altogether (though in this case, the matter will be referred on to another court).

For new drivers (those who passed their test less than two years before the alleged offence), the DVLA will automatically revoke the licence of anyone with 6 penalty points.

The Explanation
With Single Justice Procedure Notices, the courts may invoke the right to disqualify the accused from driving altogether (with a referral to another court).  If a driving ban is indeed made, the court will decide for how long it should remain in force.

To best avoid this happening or to get the very best chance of keeping the length of the ban to an absolute minimum, it is critical that you seek legal advice as soon as possible, and the earlier the better.

Depending on the exact circumstances of each case, it can be advantageous to indicate that you will plead ‘guilty’ in court WITHOUT completing the ‘mitigation’ section of the SJPN response form.

This gives you time to obtain legal advice, so that your mitigation can be expertly structured and legally crafted before the court hearing takes place, and then presented in court by your expert lawyer in a manner that gives you the very best chance of a good outcome - either avoiding a ban altogether or substantially reducing its duration.
